2. Service Description

RealtyShoot provides an on-demand platform connecting real estate professionals with vetted photographers, editors, virtual stagers, and other creative professionals for real estate media services including:

• Professional real estate photography
• Property videography and drone footage
• Floor plan drafting and 3D visualization
• Virtual staging and photo editing
• Media management and delivery tools

3. User Accounts

3.1 Account Registration

To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify RealtyShoot immediately of any unauthorized use of your account.

3.3 Account Types

RealtyShoot offers different account types:

• Client Accounts: For real estate professionals booking services
• Creative Accounts: For photographers, editors, and virtual stagers
• Admin Accounts: For platform administrators

4. Booking and Payment Terms

4.1 Service Booking

Clients may book services through the platform by selecting desired services, property details, and scheduling preferences. All bookings are subject to creative availability and confirmation.

4.2 Pricing

Service prices are displayed on the platform and may vary based on property type, location, service package, and additional requirements. All prices are in USD unless otherwise specified.

4.3 Payment Processing

Payments are processed securely through third-party payment processors (Stripe, PayPal). By providing payment information, you authorize RealtyShoot to charge your designated payment method for services booked.

4.4 Cancellation and Refunds

Cancellation policies vary by service type and timing. Generally:

• Cancellations 24+ hours before scheduled service: Full refund
• Cancellations 12-24 hours before: 50% refund
• Cancellations less than 12 hours before: No refund

5. Creative Professional Terms

5.1 Application and Vetting

Creative professionals must apply and pass RealtyShoot's vetting process, which may include portfolio review, background checks, and skills assessment.

5.2 Service Standards

Creative professionals agree to:

• Deliver services according to platform quality standards
• Meet agreed-upon deadlines (typically 24-hour turnaround)
• Provide professional communication with clients
• Use professional-grade equipment and software

5.3 Payment to Creatives

Creative professionals are paid according to the payment structure agreed upon during onboarding. Payments are processed through PayPal or direct deposit after job completion and client approval.

6. Intellectual Property Rights

6.1 Platform Content

The RealtyShoot platform, including its design, features, and functionality, is owned by RealtyShoot and protected by copyright, trademark, and other intellectual property laws.

6.2 Media Rights

Upon full payment, clients receive a non-exclusive, royalty-free license to use delivered media for real estate marketing purposes. Creative professionals retain copyright but grant clients perpetual usage rights for the specific property.

6.3 Portfolio Usage

Creative professionals may use delivered media in their portfolios unless explicitly prohibited by the client in writing.

7. Quality and Delivery Guarantees

RealtyShoot guarantees:

• 24-Hour Turnaround: Most services delivered within 24 hours of shoot completion
• Quality Review: All media reviewed before delivery to clients
• Revision Rights: Clients may request reasonable revisions within specified timeframes

8. Prohibited Activities

Users may not:

• Circumvent the platform to engage in direct transactions with creatives
• Share account credentials with others
• Upload malicious code or attempt to compromise platform security
• Harass, abuse, or threaten other users
• Violate any applicable laws or regulations
• Use the platform for fraudulent purposes

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALTYSHOOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

RealtyShoot's total liability for any claims arising from use of the platform shall not exceed the amount paid by the user in the twelve (12) months preceding the claim.

10. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Users waive their right to participate in class action lawsuits.

11. Modifications to Terms

RealtyShoot reserves the right to modify these Terms of Service at any time. Users will be notified of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified terms.
